- The Equal
Employment Opportunity Commission (EEOC) approved a final version of
regulations interpreting Title II of the Genetic Information
Nondiscrimination Act ( GINA ). GINA prohibits "Employers" and "Health
Insurers" from discriminating on the basis of genetic information, and
imposes strict confidentiality requirements regarding genetic information.
Title II of GINA
- Strictly
Prohibits Employers from
collecting genetic information from employees, and using this information to
make decisions regarding Hiring, Firing, or any other term of employment.
Genetic Information
Nondiscrimination Act ( GINA )
also states that All Employers, also including Labor Unions and
Employment Agencies, must adhere to strict guidelines regarding genetic
information, and that it is prohibited to retaliate against an individual for
opposing acts made lawful by GINA.
The New GINA requirements "apply to
all" - Private, State, and Local Government Employers, with
15 or more employees.
President Bush Signs Genetic Information Nondiscrimination Act of 2008
( H.R. 493 )
On May 21, 2008, President Bush
signed the Genetic Information Nondiscrimination Act ( GINA ) of 2008 which
prohibits discrimination by employers and health insurance companies on the
basis of genetic information. The employment provisions of GINA will take
effect in November 2009, and will be enforced by the Equal Employment
Opportunity Commission (EEOC).
